Cancellation of Order
Poompugar.com reserves the right to cancel any order without any explanation for doing so, under situation where Poompugar.com is not able to meet the requirement of the order placed or order so placed/canceled does not comply with the Poompugar.com policy or for any other reason. However, Poompugar.com will ensure that any communication of cancellation of an order, so canceled, is intimated within appropriate time to the concerned person and any applicable refund, will be made in a reasonable time.
Limitation of Liability
In no event shall Poompugar.com be liable for any special, incidental, indirect or consequential damages of any kind in connection with this agreement, even if Poompugar.com has been informed in advance of the possibility of such damages.
Indemnity
You shall indemnify and hold harmless Poompugar its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of your breach of this Terms of Use, Privacy Policy and other Policies, or your violation of any law, rules or regulations or the rights of a third party.
Applicable Law
This Agreement shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Karaikudi.
General Terms Regarding Delivery Periods Of The Merchandise
You agree that Poompugar.com , despite its best efforts may not be able to deliver the merchandise as indicated below for every product on the website. The delivery periods mentioned with every product at best are indicative.
You agree that Poompugar.com has no responsibility or liability for the delayed delivery of the merchandise. You acknowledge that Poompugar.com reserves the right to deliver your order at any time.
In case the Poompugar.com is not able to deliver the merchandise ordered within a reasonable period of time, you may opt for a refund of the payment for the undelivered merchandise and Poompugar.com shall refund the amount equal to the price of the undelivered merchandise.
